An Owen Sound woman is fighting to keep her child in Canada.
Jessica Fleguel along with family members and friends held a protest outside the Owen Sound courthouse this morning.
She is the mother of two year old Daine Fleguel-Cannock; the father is a permanent resident of Australia, and currently lives in that country.
The boy was born in Canada, but Fleguel did move back to Australia afterward.
Fleguel says the judge has told her the boy should be sent to Australia for custody hearings, under a special United Nations treaty.
Supporters of Fleguel say this goes against Daine’s consititutional right to remain in Canada, and the UN has no business governing Canadians.
Fleguel says the justice told her he first wants to find out if there is a children’s aid service in Australia, because she says the father has harmed her and made threats.
Fleguel says she could move to Australia with Daine, but she is seven months pregnant and has another seven year old son here she doesn’t want to uproot.
But if she doesn’t go with him, Fleguel says it’s very possible Daine could end up in foster care in Australia.
Right now, supporters working on gaining government attention by writing letters to Bruce Grey Owen Sound MP Larry Miller, in hopes that he will ask parliament to step in on the matter.
Fleguell says when the order is made official, they’ll ask for a stay, and then have 30 days to file an appeal.
