Possible legal ramifications may prevent the Bluewater Snowmobile Club in using Simons Bridge as a crossing.
Brockton Council was informed by their legal counsel that they may be responsible for damages and/or injuries if the club is allowed to use the bridge..
The bridge has been closed since this past summer after it was deemed unsafe for public use and Council previously decided not to spend money to repair it.
Mayor Charlie Bagnato says by letting the organization use the bridge it will give the impression that it is safe for public use.
He says the bridge is owned by the Municipality and it is not in good shape..
He says the Municipality simply cant wash their hands of it.
Bagnato says the club wants to use the bridge as a connecting link for their trail.
He says the Municipality was trying to accommodate the request from the club.
Bagnato says the Municipality hasnt been able to take down the bridge due the amount of gravel around it.
Council accepted staff recommendation and passed the proposed by-law in its first and second readings at Mondays meeting.
The Municipality will inform the club of their decision and will continue to work something out.
