It’s back to court again for Durham area raw milk farmer Michael Schmidt.
You may remember he won his court battle with the Ontario government in January of 2010, when he was pronounced “not guilty” of all 19 charges against him.
On Wednesday — the government appeal of his acquittal will be heard in a Newmarket court.
Karen Selick is a lawyer with the “Canadian Constitution Foundation”, and she will represent Schmidt.
Selick will argue that Schmidts acquittal should be upheld, and that individuals have the right to determine what foods they choose to consume.
That she says is part of the right to life, liberty and security of the person guaranteed by Canadas Charter of Rights and Freedoms.
Selick says the Ontario government will be arguing that the judge in the original trial erred in his ruling.
The appeal will likely last all day Wednesday and Selick says the judge will likely take several months to review the case before handing down a decision.
