The municipality of York Region had wanted a finding of contempt made against Michael Schmidt.
The region accuses Schmidt of violating a court order requiring him to obey a health unit directive to stop selling unpasteurized milk.
The judge decided the consequences of a contempt finding, which include possible jail time, were too severe to contemplate without a proper trial.
The raw milk war began in November 2006 when health officials raided Schmidt’s farm.
About 50 of Schmidt’s supporters were in court today in Newmarket, Ont., to bolster his cause.
