An appeal of Michael Schmidt’s acquittal on charges linked with the distribution of raw milk has been delayed.
It was to get underway today (Tuesday) Feb. 8th, in Newmarket court.
However, Schmidt tells Bayshore Broadcasting news… he has filed new motions backing his constitutional arguments….
His latest arguments involve freedom of association and religion.
Schmidt says the appeals judge ruled in favour of his latest motions and he can now call new witnesses ….
The Crown is appealing Schmidts’ acquittal on 19 charges filed under the province’s public health regulations, the Ontario Milk act… .and the Health Protection and Promotion act.
The charges were laid after a raid on his Durham area farm back in 2006.
During his trial in 2009, Schmidt argued the ban on raw milk sales violates the guarantee of life, liberty and security of the person under the Charter of Rights and Freedoms.
Now that Schmidt is being allowed to call more witnesses in support of his constitutional arguments, the appeal won’t be heard until April 11th, in Newmarket.
