It’sa huge legal victory for a Chepstow area farm family, embroiled in a lengthy legal battle with the Provincial Government.
It was over buried highway waste that contaminated their farm land and well water and caused serious health problems in their dairy cattle.
In a short ruling Thursday — the Supreme Court of Canada has agreed to hear the appeal of Dairy Farmers Ben and Maria Berendsen.
They initially won a 1.7 million dollar settlement from the Province for negligence, but that was overturned by the Ontario Court of Appeal late last year.
Lawyers for the family say the Supreme Court not will decide this dispute after more than 6 years of litigation.
They say its anticipated the appeal will focus on to what extent governmental ministries or agencies should be held liable in negligence for their acts in regards to environmental contamination.
