Two year old Daine Fleugel-Cannock is at the centre of the battle under the Hague International convention between his mother in Owen Sound, and his father in Australia.
Yesterday Justice Thompson ruled it is up to the courts in Australia to determine custody issues.
Craig Cannock has obtained an interim court order that grants him sole parental responsiblity, which will be reviewed in March of next year.
Judge Thompson’s order requires Cannock to agree to certain conditions… including an assurance he will live with Daine at his grandparents home in Australia.
The boy’s grandmother in Owen Sound, Esther Gierenger says Cannock signed the judge’s assurance request but she feels it will simply be ignored by the father.
She says Daine’s mother Jessica Fluegel will not go to Australia to battle for custody but is looking at ways of doing it from here.
This Monday Jessica must hand over Daine at the Owen Sound police station to his maternal grandmother who will fly back to Australia with him on Tuesday.
