A very public custody battle is back before the court in Owen Sound this afternoon.
Two year old Daine Cannock was born in Australia and spent the majority of his life so far in that country.
His mother Jessica Fleguel fled what she claims was an abusive relationship with the boys father last November and returned to Grey county.
Craig Cannock sought to have the custody case heard in Australia under the Hague Convention.
The case is in the Ontario Court of Justice and judge Robert Thompson is to decide tomorrow whether the custody battle will be moved to Australia.
The boy’s grandmother Esther Gieringer says Daine’s constitutional rights are being violated and says the whole thing is ridiculous.
Gieringer has fired off a letter to Canada’s Minister of Citizenship and Immigration, Diane Finlay hoping she will get involved and stop the boys’ transfer to Australia.
It is expected the judge will rule later today that Daine must go to Australia and be placed in Foster care, while the custody battle goes before a court there.
If that happens the mother Jessica Fleguel is likely to file an appeal.
