No ruling yet …. but Durham area farmer Michael Schmidt was pleased with his court appearance in Newmarket.
Schmidt is a raw milk producer who is battling with the MNR and the Grey Bruce health unit over the right to sell his milk to the public.
In court yesterday, Schmidt argued that the case should be thrown out because the search warrent had the wrong address on it.
The MNR and Health unit seized his milk making equipment in late 2006 and only returned it to his farm this week.
Schmidt says yesterday’s session was a pre-trial hearing and the judge cannot rule on his an application for a summary judgement in the case.
The raw milk case will return to court JULY 4TH, and the Durham area farmer is confident he’ll win.
If not, Schmidt says the issue won’t go away.
He says a lot of people are concerned about food bought in grocery stores and they want to get their milk directly from the farmer.
He claims producing raw milk for human consumption is different from the milk going to pasteurization.
Schmidt says it is time for the government to sit down with him and negotiate a proceedure for producing raw milk that can be sold in Canada.
He says it is sold overseas all the time.
