The Friends of Saugeen Shores or FOSS have asked for a review of the Ontario Municipal Board decision on the Wal Mart issue.
On Soundingboard today FOSS lawyer Eric Gillespie says the group continues to have concerns about people’s safety, increased highway traffic on Highway 21 and the lack of public transit in Saugeen Shores.
Although the issues were discussed in the OMB hearing, Gillespie says the group feels some points were missed while others didn’t receive discussion and under the legislation they are entitled to ask for a review of the decision.
The OMB has said in its report that it doesn’t have legal jurisdiction to either consider or remedy some of the issues brought forward by FOSS.
Gillespie says it ‘s not known when the OMB would hand down its decision on the review request but he believes it will be sooner rather than later.
Any costs associated with this latest move will be the responsibility of the community association.
He says FOSS did decide not to seek leave to appeal to the judicial system which he says would have taken far longer than the route they’ve chosen.
Gillespie says in other cases when a review was asked, any behind-the-scenes work on the project usually came to a standstill.
Saugeen Shores council is meeting in special session tonight (MON) to pass a by-law to authorize the pre-service agreement with Shoreline Shopping Centres Limited.
That portion of the meeting is open to the public.
Under the circumstances, it’s not known whether that bylaw will proceed.
