The College of Physicians and Surgeons of Ontario (CPSO) is looking to the Ontario Superior Court of Justice to compel four doctors to cooperate with investigations into their practices and allegations that they issued medical exemptions for COVID-19 vaccinations or testing.
One of the physicians is Owen Sound doctor Rochagné Kilian. Also being investigated are Dr. Mary Elizabeth O’Connor, Dr. Mark Raymond Trozzi and Dr. Celeste Jean Thirlwell.
The CPSO has filed a Notice of Application for each doctor and says in all four cases, their investigations began after information was received which the college says, “Includes copies of inappropriately issued exemptions.”
A release from the CPSO says, “Dr. Kilian’s Notice of Application says the College has received confirmation that she provides medical exemptions through Enable Air, a website that facilitates the purchase of vaccination exemptions.”
The College quotes the Enable Air website as saying the exemption documents are “legal declarations of noncompliance,” and says it describes the vaccine passport as a ‘fascist document.’
The College also claims, “Dr. Kilian has taken the position that the College does not have the ‘jurisdiction’ to request patient lists and patient charts.”
The CPSO’s Investigations, Complaints and Reports Committee (ICRC) issued an interim suspension of Kilian’s licence on October 27th. A suspension of her certificate of registration (licence) means Kilian is prohibited from practicing medicine while the restrictions are in place.
Before that, Kilian and Trozzi were barred by the ICRC of the College from providing medical exemptions in relation to COVID-19 vaccines, mask requirements and testing.
Killian can choose to appeal her interim suspension directly in the Provincial courts. If she chooses to do so, the CPSO would be required to present information to support its decision.
Kilian resigned from Grey Bruce Health Services in August of 2021.
She recently set up a page on crowdfund.ca with the goal of raising $2 million for what she described on the website called “Operation Hope” as an, “Initiative to establish an Integrative Lifestyle Medical Facility for disenfranchised patients in Grey County.”
Meanwhile, Dr. Thirlwell’s Notice of Application alleges she has claimed she will resist investigations with the use of private security. The College claims Thirlwell has taken the position the College lacks jurisdiction to ‘police’ medical exemptions.
Dr. O’Connor’s Notice claims she has obstructed the College’s investigation and refused to provide medical records. It says she has demanded College must define COVID-19 first.
Dr. Trozzi’s Notice claims he has taken the position that the College does not have a legal basis to request patient lists and charts and that an Ontario doctor is free to provide medical exemptions relating to COVID-19 vaccinations as he or she sees fit.
The allegations against the doctors have not been proven in court.
